China NMPA and Imported Used Medical Devices: Registration Realities

China NMPA and Imported Used Medical Devices: Registration Realities

China NMPA imported medical device registration is built around a domestic agent and a new-device dossier. Here is why used equipment is a difficult category.

China NMPA and Imported Used Medical Devices: Registration Realities
Posted on by White, John

China\’s medical device registration system is built for devices manufactured under a controlled quality system and supported by a complete registration dossier. A used unit does not naturally fit that model. That is the core difficulty, and it is better understood before a seller invests in a listing, a translation or a freight quote.

The NMPA Structure

The NMPA, the National Medical Products Administration, regulates medical devices in China. Devices are classified into three classes, and the class determines whether the route is filing or registration before an imported device can be sold.

The NMPA framework covers registration, quality management, clinical evaluation, labelling, import clearance and post-market surveillance. Imported devices are handled through a domestic agent, and the registration certificate identifies the device, the manufacturer and the agent. The system is product-based, not shipment-based.

Comparable questions arise under FDA rules, the EU Medical Device Regulation 2017/745, PMDA requirements and WHO guidance, but China\’s answer is set by the NMPA and the domestic agent. China is also a market where the regulatory file is expected to be complete at submission. Missing sections are not usually resolved through correspondence; they delay the application. That is why the registration strategy should be settled before a commercial offer is made. The file is a project, not a form.

Registration and the Domestic Agent

An imported device needs an NMPA registration or filing held through a domestic agent established in China. The agent is the local applicant and the point of contact for the authority, and it carries responsibilities that continue after registration.

The domestic agent is not a forwarding address. It submits the application, holds the registration certificate, communicates with the NMPA and supports post-market obligations. The foreign manufacturer provides the technical file, the quality-system evidence and the clinical evaluation materials, and it remains responsible for the device\’s conformity.

The agent\’s appointment should be in writing and should cover the specific device family, not only a general distribution relationship. The NMPA file will name the agent, and a change of agent is a regulatory event rather than a commercial footnote. For a used unit, the agent is the party that has to decide whether the unit can be brought within the registered device. That decision is not only commercial. It affects the registration status, the labelling and the post-market record, and it should be documented before the unit is shipped.

Class-Based Requirements

China uses three classes. Class I devices follow a filing route, while Class II and Class III devices require registration, with Class III carrying the highest evidence expectations. The class determines the technical and clinical evidence the application needs.

The registration dossier includes the device description, specifications, risk analysis, quality-system evidence, labelling and clinical evaluation. The manufacturing site is subject to quality-system requirements, and the registration is tied to the device and the site. A change to the device, the site or the manufacturing process can require a change to the registration.

For an imported used unit, the class still matters, but the more fundamental question is whether the unit can be treated as the registered device at all. A unit that has been rebuilt, modified or relabelled may not fit the registered configuration, and the agent should assess that before the import route is chosen.

Used Equipment: The Core Difficulty

Used medical equipment is a difficult category in China. The registration system assumes a device manufactured under a controlled quality system and supported by a dossier that describes its design, production and verification; a used unit arrives with a history that the original registration does not describe.

Imports of used medical devices are subject to significant restrictions, and many categories are not accepted for clinical use. Some units may be importable for non-clinical purposes, such as research, training or parts, under a different route, but that is not the same as placing a used device on the market for patient use. The exporter should confirm the current position with the Chinese agent and the NMPA before offering a unit.

The practical consequence is that \”can it be registered\” is often the wrong first question. The better question is whether the unit is eligible for import at all, and if it is, whether the registered device covers it. A seller who cannot answer the eligibility question should not invest in a registration strategy. The eligibility assessment should be written down as a decision record: the device type, the proposed use, the import route, the registration position and the evidence relied on. That record protects the exporter and the agent if the position is questioned later, and it prevents the same conversation being repeated with every new buyer.

Clinical Evaluation Expectations

Clinical evaluation is part of the registration dossier for many devices. The evidence can come from clinical literature, equivalent devices or clinical trials, depending on the device and the route, and the NMPA has its own expectations for accepting overseas data.

For a used unit, the clinical evaluation question is secondary to the eligibility question, but it still matters if the unit is presented as the registered device. The evaluation supports the device and its intended use, not the condition of a particular unit. The condition evidence is a separate file: service history, parts, software, calibration and performance verification.

The clinical evaluation is not a substitute for the unit\’s condition evidence. A positive evaluation of the device does not establish that this particular unit performs to specification; that is what the service and calibration records are for. The two files answer different questions, and a buyer should not accept one as evidence of the other. The agent and the regulatory consultant should confirm the clinical evaluation route before the dossier is assembled. A route that assumes new-device manufacturing data may not be available for a used unit, and the gap should be identified early.

Labelling and Chinese Language

Labels and instructions for the Chinese market must be in Chinese and must match the registered content. The label identifies the device, the manufacturer, the registration number and the domestic agent where required.

A used unit with an English or European label will need a Chinese label or overlay before it can be supplied. The overlay must be controlled and must not obscure required information. Keep the original label photograph, the approved artwork and the applied result in the unit file. A label that changes the device identity or the registration details is not a cosmetic change.

The manual should match the software version and configuration. A Chinese manual for a different version creates a safety and a registration problem at the same time. Confirm the version and the completeness of the instructions before the unit ships.

Customs and Inspection

Customs clearance requires the registration or filing details, the import documents and a declaration that matches the registered device. The NMPA registration certificate is part of the clearance file, and an import that does not match it can be held or refused.

Inspection can cover the device, the labelling and the condition. Used equipment may attract additional questions about prior use, decontamination and the absence of prohibited components. A clean decontamination record and a packing declaration support the clearance, but they do not replace the registration position.

Where the unit is held at the port, the importer should ask for the specific ground of the hold in writing. A hold based on the registration position is a different problem from one based on labelling or valuation, and the remedy is different. The export-side sequence is covered in the guide to exporting medical equipment from Hong Kong. The importer should confirm the document set with the customs broker and the agent before the shipment is booked. A shipment described as general machinery or spare parts creates a mismatch that is difficult to correct after arrival.

What a China-Ready File Looks Like

A China-ready file connects the registration, the domestic agent and the specific unit. The table below is the working set; each missing item should be recorded and assessed rather than replaced by an assurance. Build the file in the order the registration is reviewed: device description, classification, technical evidence, clinical evaluation, labelling and quality-system evidence. Then add the unit file: service history, software, accessories, calibration and decontamination. Keeping the two files separate makes it clear which document supports the device and which supports the unit.

Records and checks: the China entry file

Document What it proves What its absence leaves open
NMPA registration or filing That the device has a Chinese regulatory position Whether the unit can be imported for sale
Domestic agent appointment Who is accountable locally Who can hold the registration and answer the NMPA
Quality-system evidence That the manufacturing site meets the applicable requirements Whether the device family is covered
Technical file The device\’s specifications, risk analysis and verification Whether the used unit matches the registered device
Clinical evaluation The evidence supporting the intended use Whether the registration route can be completed
Chinese label and instructions That the unit is labelled for the market Whether it can be released after arrival
Service and calibration records What was done and whether performance was verified Whether the condition matches the description
Software and accessory list The configuration and what is included Whether the unit is complete and consistent
Decontamination record That the unit was cleaned and prepared for transport Whether inspection or handling risk remains

Questions About China

Can used medical devices be imported into China?

Used medical devices face significant restrictions in China, and many categories are not accepted for clinical use. Some units may be importable for non-clinical purposes under a different route. The exporter should confirm eligibility with the Chinese agent and the NMPA before offering a unit for sale.

What is a domestic agent in NMPA registration?

The domestic agent is a China-established entity that submits and holds the registration or filing, communicates with the NMPA and supports post-market obligations. The foreign manufacturer provides the technical file and remains responsible for the device\’s conformity.

Does NMPA registration cover refurbished units?

Registration covers the registered device and its configuration, not an individual unit. A refurbished unit may fall outside that configuration if it was significantly modified or relabelled. The agent should assess whether the unit still matches the registration before import.

What are the main regulations governing medical devices in China?

The core framework is the Medical Device Supervision and Administration Regulation, supported by NMPA rules on registration, quality management, clinical evaluation, labelling and post-market surveillance. The class of the device determines the filing or registration route.
